The controversial data center in Vineland, Cumberland County, was fined $1.07 million for violating the Air Pollution Control Act, Gov. Mikie Sherrill announced on Tuesday.

The fine is the largest enforcement action against a data center in New Jersey's history, Sherrill said in a press release.

“Today, we are taking action against Data One in Vineland for violating New Jersey pollution law with a $1.07 million fine, the largest in state history," Sherrill said. "I said from the beginning that we are going to hold data centers accountable, period."

The fine stems from a July 29 inspection that found 62 large natural-gas generators that were installed and operating at the data center site without proper New Jersey Department of Environmental Protection permits, Sherrill said.

Data One, the company behind the data center, said in a statement that they disagreed with the ruling.

"“As announced in the Spring, we are transitioning to low-emission, quiet fuel cells as part of the site’s permanent power solution and have the necessary approvals in place for this solution," a company spokesperson told NBC10. "While we disagree with the temporary generator determination, we will apply for the air permits for the temporary generators and are in communication with the Department of Environmental Protection regarding its findings and the fuel cell transition timeline.”

Vineland residents have pushed back against the date center, with people expressing concerns over resource usage, as well as a humming noise that appears to be coming from the data center.
