Personal laws in India: How they govern marriage, divorce, and inheritance for different religions

In India, personal laws dictate the rules for marriage, divorce, and inheritance for diverse religious groups. These laws not only uphold religious traditions but also align with constitutional rights. The Special Marriage Act provides a secular alternative for those seeking civil or interfaith unions.

What are personal laws?

Personal laws are a set of religion-based legal frameworks that govern matters related to inheritance, succession, marriage, divorce, maintenance and adoption. These laws respect the traditions and customs of different religions and communities, and are aligned with the constitutional rights of individuals.

Hindus

The Hindu Personal Laws are applicable to Hindus, Sikhs, Buddhists and Jains and relate to succession, marriage, adoption and guardianship rights. These are governed by the Hindu Marriage Act 1955, Hindu Succession Act 1956, Hindu Adoptions and Maintenance Act 1956, and Minority and Guardianship Act 1956.

Muslims

The Muslim Personal Laws are governed by the Muslim Personal Law (Shariat) Application Act 1937. These provide guidelines for marriage (nikah), divorce (talaq), inheritance (virasat), and maintenance (nafqah), among others.

Christians

Governed by the Indian Christian Marriage Act 1872, Indian Divorce Act 1869, and the Indian Succession Act 1925, these laws decide the rights of Christians in marriage, divorce (separation, alimony and child custody), as well as succession.

Parsis

While the Parsi Marriage and Divorce Act of 1936 governs the issues related to marriage and divorce among Parsis, their inheritance rights are defined by the Indian Succession Act 1925.

Special Marriage Act 1954

This is a secular provision that provides a framework for civil marriages, where the partners can be of any religion, faith, caste or community. It governs inter-faith marriages and rights of individuals, and is considered a civil contract validated by the state instead of religion. The marriages under the Special Marriage Act are not governed by the personal laws of different religions.

Uniform Civil Code

Article 44 of the Indian Constitution promotes the setting up of a Uniform Civil Code, a single set of personal laws for all citizens, irrespective of their religion, caste or faith. While it has not been passed as an Act, it aims to transcend the personal laws of different religions and promote gender equality when it comes to marriage, divorce and succession rights.
