Lindsay Clancy is back in court for the first time since her murder trial for strangling her three children ended in a hung jury last month.

Lindsay Clancy is back in court for the first time since her murder trial for strangling her three children ended in a hung jury last month.

The 36-year-old former labor nurse faces a pivotal hearing that could determine whether she is retried for murder, while her defense lawyer will ask to have the case dropped completely.

On Tuesday morning, Clancy defense lawyer Kevin Reddington slammed laypeople and politicians who have openly criticized Clancy without understanding the details of the case. 'She’s a demon and possessed and should be executed,' he said people think. 

'This is coming from politicians, from President Trump, all the way down,' he continued. 

Clancy has admitted killing her children, Cora, five, Dawson, three, and eight-month-old Callan in 2023, but pleaded not guilty by reason of insanity, claiming she was suffering postpartum psychosis.

After a grueling five-week trial, the jury failed to reach a unanimous verdict with one holdout juror, who has since been identified as Michael Desronvil, refusing to join the panel's consensus.

Since the trial ended on September 4, jurors waived their anonymity to share their stories with the media and accused Desronvil of refusing to follow the law when it came to reasonable doubt. 

The juror denied the allegations and told NewsNation that he 'didn't have any doubts' that Clancy was guilty based on the evidence presented in the courtroom. 

Reddington pointed out two aspects of criminal responsibility and said laypeople struggle to understand it.

When people hear that she admitted to it, they go off on a tangent.

'She’s a demon and possessed and should be executed,' he said people think.

'This is coming from politicians, from President Trump, all the way down.'

Clancy is watching Reddington intently as he speaks. She closed her eyes momentarily for a long pause.

Kevin Reddington says retrial could not happen before June 2027

Reddington claimed that Tuesday morning's hearing 'went well,' although he declined to comment on Lindsay Clancy's reaction.

He said he could not do a retrial before June as he had 'other cases' and that his schedule was 'jammed up.'

Kevin Reddington addresses juror criticism claims

'I argued that in the trial, I argued it in the motion for required finding, it's not rocket science by any means...they cannot prove probable cause,' Lindsay Clancy's lawyer Kevin Reddington said outside of court on Tuesday afternoon.

'I'm really tired of hearing that I am attacking this juror, ripping the juror, shredding the juror...I'm not doing of the sort. I filed the motion weeks ago based on what was reported by the forelady.'

'It's not my fault that this guy from Houston, who is not a serious person, ends up making statements repeatedly, continuously, fanning the flames to hear himself talk,' he said, seemingly referring to the holdout juror's attorney, Ed Paltzik.

'I don't need any gag orders either,' he declared.

Holdout juror's attorney speaks to the press

The holdout juror's attorney, Heather O'Connor, spoke to the press outside of the courthouse on Tuesday.

She said the juror is worried about his safety and security.

The lawyer also said the money raised on GoFundMe for the juror was used to pay her legal fees and that, the way things have played out, he will need money for protection.

District Attorney Cruz says he has not made a decision on retrying Clancy

District Attorney Tim Cruz said they haven't decided yet whether to retry the case or what charges he would bring if they do.

'No determination has been made. We're doing our due diligence,' he told reporters as he left the courthouse on Tuesday.

Judge tells lawyers to be prepared to pick a trial date at next hearing

Lindsay Clancy's status hearing ended without a ruling on any motions or a trial date set.

Kevin Reddington told the judge he would not be able to go to trial until June.

Judge Sullivan told the lawyers to be prepared to schedule a trial at the November 2 hearing.

'That’s my goal to get this thing tried as soon as possible,' the judge said.

Reddington jumps up to defend himself from 'juror persecution' accusations

Kevin Reddington jumped up to defend himself after the prosecution argued the jury note should not be released to prevent jury persecution.

'I am so tired of hearing "persecution," "attacking," I am doing all these terrible things to this juror,' Reddington said.

'I filed one motion and said nothing. Every comment I have made has been a reaction to people from Donald Trump down to Nancy Mace down to Cruz, not the DA but the politician, calling for her execution.

'I have responded to these outlandish comments, including the guy from Houston.'

He continued: 'I'm just tired about hearing me persecuting people

Sprauge jumped in, 'I never said...' before the judge cut her off.

Judge takes motion under advisement

Judge Sullivan said he will take the motion to release the juror notes under advisement and will rule at a later date.

Prosecution claims releasing jury note would have a 'chilling effect'

ADA Sprague said that releasing the information could have a 'chilling effect' on potential jurors - they would fear serving on a jury and sending juror notes.

Reddington challenged prosecution's description of Clancy's mental health

During his argument on a required finding, Kevin Reddington accused the prosecution of changing their stance on Clancy's mental health.

Reddington claimed that the prosecution started the case by arguing that Clancy faked her suicide and alleged that she killed her children because she did not want to be a mother.

After hearing from experts, Reddington said the prosecutors 'backed off on that like a poodle on a linoleum floor.'

Lindsay Clancy's new attorney, Martin Weinberg, is now arguing that the jury notes and sidebar conversations be made public.

The juror notes detail the issues in the jury room with the holdout member.
