Electric-vehicle maker Tesla has seen several lawsuits filed against it for alleged unfair treatment of certain employees, and one of the biggest of those cases is set to go to trial next week. California’s Civil Rights Department filed the suit against the company in February 2022 over accusations of discrimination against Black workers at its flagship Fremont facility in that state; Tesla counter-sued in September. The trial is scheduled to kick off Monday, September 28.
Set to be run by state Superior Court Judge Peter Borkon, it’s expected to take about a month, with an expected wrap-up date of one day before Halloween. This case is apparently just one of many lawsuits against Tesla regarding these sorts of allegations, with numerous individual suits on the books in addition to this overarching one from the state agency.
The department’s director, Kevin Kish, said the agency intends to hold Tesla accountable for alleged actions reported by Tesla employees, including claims of harassment against Black workers by their colleagues, which apparently included slurs and objectionable graffiti, that the company did nothing to address. The suit also levels accusations of Tesla implementing a tiered pay system that stuck Black workers with lower wages; and unfair assignment of duties or promotions based on race.

The judge has scheduled what’s called a bench trial, meaning there is no jury involved as part of the proceedings. California law apparently doesn’t place a cap on the penalties in these types of trials if a guilty verdict is reached, meaning Tesla could be on the hook for millions of dollars, depending on the outcome.
This isn’t the first time Tesla has been wrapped up in this type of lawsuit, with a former worker at the Fremont plant having been awarded some $137 million as part of an individual court action, though that amount was later reduced by another judge.
